In addition, data processors commissioned by us (e.g., operators of a data center) receive your data if it is needed to fulfill their tasks. All data processors (in other words, service partners who process data on our behalf) provide their services within the framework of a contract that complies with data protection regulations, obliging them to treat your data confidentially and to process it only within the scope of service provision.

Your data will not be disclosed to other unrelated third parties, nor do we sell it for advertising purposes to commercial users.

We only transfer or process data in countries outside the EU (third countries) when you consent to such processing, when it is legally required, or contractually necessary, and in any case only to the extent permitted by law. In most cases, your consent is the primary reason for us to process data in third countries. Processing personal data in third countries, such as the USA, where many software providers offer services and have their server locations, may mean that personal data is processed and stored in unexpected ways.

We expressly point out that, in the opinion of the European Court of Justice, there is currently no adequate level of protection for data transfer to the USA. The processing of data by US services (such as Google Analytics) may result in data being processed and stored in a non-anonymized manner. Additionally, US government authorities may potentially access individual data. Furthermore, collected data may be linked with data from other services of the same provider if you have a corresponding user account. Whenever possible, we strive to use server locations within the EU, if offered.

To protect your data, we have implemented appropriate technical and organizational measures to safeguard against loss, manipulation, or unauthorized access. These measures are continuously adjusted to the current state of technology.

The processing of access data is based on the legal basis of legitimate interest according to Art. 6 para. 1 lit. f GDPR. The legitimate interest of AQG lies in ensuring a corresponding web service offering and data security.

Legal Basis

Since 2009, there have been "cookie guidelines" that stipulate that storing cookies requires your consent (Article 6 para. 1 lit. a GDPR). Within EU countries, there are still diverse reactions to these guidelines. In Austria, however, these guidelines were implemented in § 96 para. 3 of the Telecommunications Act (TKG). In Germany, the cookie guidelines were not transposed into national law. Instead, the implementation of these guidelines largely occurred in § 15 para. 3 of the Telemedia Act (TMG).

For strictly necessary cookies, even where no consent is given, legitimate interests exist (Article 6 para. 1 lit. f GDPR), which are mostly of an economic nature. We want to provide website visitors with a pleasant user experience, and certain cookies are often essential for that.

What is Web Analytics?

We use software on our website to analyze the behavior of website visitors, commonly referred to as Web Analytics. During this process, data is collected, stored, managed, and processed by the respective analytics tool provider (also known as a tracking tool). The collected data is used to generate analyses of user behavior on our website, which is then provided to us as the website operator. Additionally, most tools offer various testing capabilities. For example, we can test which offers or content are most appealing to our visitors. To do this, we might display two different offers for a limited time, and after the test (known as an A/B test), we determine which product or content our website visitors find more interesting. For such testing procedures, as well as other analytics processes, user profiles can be created, and data can be stored in cookies.

Why do we operate Web Analytics?

With our website, we have a clear goal in mind: we aim to deliver the best web offering in the market for our industry. To achieve this goal, we want to provide the best and most interesting offerings while ensuring that you feel completely comfortable on our website. Web analytics tools allow us to examine the behavior of our website visitors more closely and, accordingly, improve our web offering for both you and us. For example, we can identify the average age of our visitors, where they come from, when our website is most frequently visited, or which content or products are particularly popular. All this information helps us optimize the website and tailor it to your needs, interests, and wishes.

What data is processed?

The specific data stored depends on the analytics tools used. However, in general, it typically includes information such as which content you view on our website, which buttons or links you click, when you access a page, which browser you use, on which device (PC, tablet, smartphone, etc.) you visit the website, or what computer system you use. If you have consented to the collection of location data, this information may also be processed by the web analytics tool provider.

Additionally, your IP address is also stored. According to the General Data Protection Regulation (GDPR), IP addresses are considered personal data. However, IP addresses are generally pseudonymized (stored in an unrecognizable and truncated form). For the purpose of testing, web analytics, and web optimization, no direct data, such as your name, age, address, or email address, is generally stored. All such data, if collected, is pseudonymized so that you cannot be identified as an individual.

The duration for which the respective data is stored depends on the provider. Some cookies store data only for a few minutes or until you leave the website, while others can store data for several years.

Duration of Data Processing

In general, we process personal data only for as long as it is absolutely necessary for the provision of our services and products. If, as in the case of accounting, it is legally required, this storage period may be exceeded.

1.4 Google-Re/ Marketing-Services

We use the Google Marketing Services based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offering within the meaning of Art. 6 para. 1 lit. f. GDPR). The Google Marketing Services (short "Google Marketing Services") of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) ("Google") allow us to display advertisements for our website more specifically, either on our website or on external sites, to users who are potentially interested. If a user, for example, sees ads for products they previously viewed on other websites, this is referred to as "remarketing." For these purposes, when our and other websites where Google Marketing Services are active are accessed, Google directly executes code and incorporates so-called (re)marketing tags (invisible graphics or codes, also known as "web beacons") into the website. With the help of these tags, an individual cookie, i.e., a small file, is stored on the user's device (instead of cookies, comparable technologies can also be used). These cookies can be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com, or googleadservices.com. This file records which websites the user has visited, which content they are interested in, and which offers they have clicked on, as well as technical information about the browser and operating system, referring websites, visit time, and further information about the use of the online offering. The IP address of the user is also recorded; however, within the framework of Google Analytics, we inform that the IP address is shortened within member states of the European Union or in other contracting states of the Agreement on the European Economic Area and only in exceptional cases is transferred in full to a server of Google in the USA and shortened there. The IP address will not be merged with user data within other Google offers. The information collected by Google Marketing Services about users is transmitted to Google and stored on Google's servers in the USA.

The data of users processed within the Google Marketing Services is processed pseudonymously, i.e., Google stores and processes, for example, not the name or email address of users, but processes the relevant data cookie-related within pseudonymous user profiles. From Google's point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie owner, regardless of who this cookie owner is. This does not apply if a user has expressly allowed Google to process the data without this pseudonymization. The information collected by Google Marketing Services about users is transmitted to Google and stored on Google's servers in the USA. Among the Google Marketing Services we use is the online advertising program "Google AdWords." In the case of Google AdWords, each AdWords customer receives a different "conversion cookie." Cookies can thus not be tracked through AdWords customers' websites. The information obtained with the help of the cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive information that personally identifies users. We may also use the "Google Optimizer" service. Google Optimizer allows us to track how various changes to a webpage (e.g., changes to input fields, design, etc.) affect user behavior through so-called "A/B testing." Cookies are placed on users' devices for these testing purposes. Only pseudonymous data of users is processed for these testing purposes. Furthermore, we use the "Google Tag Manager" to integrate and manage Google Analytics and marketing services into our website. The Tag Manager itself is a domain that does not set cookies and does not store any data. It acts as a mere "manager" of the implemented tags. The data is passed through the Google Tag Manager to the individual tracking tools and not stored.

Data that you submit to us by means of a data entry form on our website will be forwarded to the respective department for the purpose of request processing. The data will be deleted after 14 days from our web servers. Details on data forwarding can be found under "Who receives which data".

Storage Duration

The general criterion is that we only store personal data for as long as it is absolutely necessary for the provision of our services and products. If you apply for a position with us, creating a candidate profile in our application portal is required. Fields marked as mandatory must be filled in; otherwise, the creation of your candidate profile and thus the submission of your application will not be possible.

By creating the candidate profile, you agree that we may use your data - even if there is no active application - for internal job matching and may contact you to offer interesting areas of deployment. You have the right to information, correction, deletion, restriction, and data transfer of your personal data, as well as the right to object.

In the operation of our website and our application portal, the processing of your inquiries, applications, and the use of our services, we engage (software) service providers who, in the course of their activities, may access your personal data. They have committed to complying with the applicable data protection regulations towards us. By creating the candidate profile, you agree that your data, including application documents, will be passed on and processed by contact persons in the respective branches and departments within the AUGUSTIN QUEHENBERGER GROUP or companies in which a group company is involved, for the purpose of internal job matching and the entire application process. Furthermore, you agree that the companies may contact you to offer interesting areas of deployment within the respective company and/or involve you in the further stages of the application process (e.g., assessment centers, tests, etc.). You can revoke this consent at any time in your candidate profile. Simultaneously, you can delete your entire candidate profile at any time. Data Storage and Data Security

The data of your candidate profile, as well as all data, documents, and correspondence associated with the application, are generally stored for a period of 6 months after the rejection of the application. If you also accept the separate voluntary consent declaration pursuant to Art. 6(1)(a) GDPR regarding the processing of data for record-keeping purposes, your data will be stored for a period of 3 years from the date of consent.

In the case of a successful application, your data and documents will be used for the employment relationship.
