Your contact for data protection issues is our Data Protection Officer and can be reached as follows:
datenschutz@quehenberger.com or dataprotection@quehenberger.com

If you have any questions, concerns, or complaints regarding our privacy policy or our handling of your data, please contact our Data Protection Office.

The extent of processing personal data depends on various factors, such as the services you have used, the services provided and utilized by us, as well as the nature and scope of the business relationship with you, etc.

Personal data refers to information that allows conclusions to be drawn about your person. This primarily includes personal details (name, address, date of birth, contact details, etc.) or identification data such as identification documents.

Personal data can be automatically collected through your visit to our website. Details regarding this can be found under the section "Visit/Usage of our Website."

We also process data that you provide to us, for example, when you:

  • Use our inquiry form for customers
  • Use our inquiry form for transport partners
  • Utilize the online application form on our career portal

Additionally, we may obtain data from publicly accessible sources (e.g., commercial register, land register) or from third parties, such as business partners, our affiliated companies, in the context of contract negotiations, or contract fulfillment.

If you have received or entered access data, user passwords, or passwords, the secure storage and confidentiality of this data are your responsibility.

We process personal data only to the extent necessary and exclusively in accordance with applicable legal provisions, especially the General Data Protection Regulation (GDPR), and national data protection laws. Personal data is processed by us only for the purpose of carrying out pre-contractual measures, fulfilling contracts, and to fulfill other business interests or obligations, only to the extent that there is a legal basis for the processing, particularly for:

  • Fulfillment of contractual obligations (Legal basis: Art. 6 para. 1 lit. b GDPR)
  • Fulfillment of legal obligations (Legal basis: Art. 6 para. 1 lit. c GDPR)
  • Preservation of legitimate interests (Legal basis: Art. 6 para. 1 lit. f GDPR)

If there is no legal basis, data will only be processed within the scope of your consent according to Art. 6 para. 1 lit. a GDPR. You are entitled to revoke your consent to data processing at any time with effect for the future. Revocation is possible at any time via informal email (datenschutz@quehenberger.com or dataprotection@quehenberger.com) or by postal mail (to: AUGUSTIN QUEHENBERGER GROUP GMBH, Data Protection, Gewerbegebiet Nord 5, 5204 Straßwalchen).

If you receive a newsletter or participate in customer surveys based on your consent, revocation can also be made through the designated link in the email you received for this purpose.

Personal data is shared with group companies and Sequrity GmbH as an affiliated company, only to the extent legally permissible and as far as necessary for the fulfillment of a contract (Art. 6 para. 1 lit. b GDPR), to comply with legal obligations (Art. 6 para. 1 lit. c GDPR), to respond to a request according to your consent under Art. 6 para. 1 lit. a GDPR, or to carry out an order according to your consent under Art. 6 para. 1 lit. a GDPR, or based on a legitimate interest according to Art. 6 para. 1 lit. f GDPR. This also applies if you are interested in a position within one of our group companies, based on your consent under Art. 6 para. 1 lit. a GDPR or based on a legitimate interest under Art. 6 para. 1 lit. f GDPR.

Within the company, only those departments or employees who need your data for contract fulfillment (according to Art. 6 para. 1 lit. b GDPR), to fulfill legal obligations (according to Art. 6 para. 1 lit. c GDPR), or to safeguard interests (according to Art. 6 para. 1 lit. f GDPR) will receive your data. If a group company or Sequrity GmbH as an affiliated company fulfills these tasks, your data will be forwarded to the relevant company.

In addition, data processors commissioned by us (e.g., operators of a data center) receive your data if it is needed to fulfill their tasks. All data processors (in other words, service partners who process data on our behalf) provide their services within the framework of a contract that complies with data protection regulations, obliging them to treat your data confidentially and to process it only within the scope of service provision.

Your data will not be disclosed to other unrelated third parties, nor do we sell it for advertising purposes to commercial users.

We only transfer or process data in countries outside the EU (third countries) when you consent to such processing, when it is legally required, or contractually necessary, and in any case only to the extent permitted by law. In most cases, your consent is the primary reason for us to process data in third countries. Processing personal data in third countries, such as the USA, where many software providers offer services and have their server locations, may mean that personal data is processed and stored in unexpected ways.

We expressly point out that, in the opinion of the European Court of Justice, there is currently no adequate level of protection for data transfer to the USA. The processing of data by US services (such as Google Analytics) may result in data being processed and stored in a non-anonymized manner. Additionally, US government authorities may potentially access individual data. Furthermore, collected data may be linked with data from other services of the same provider if you have a corresponding user account. Whenever possible, we strive to use server locations within the EU, if offered.

We will provide you with more detailed information on data transfers to third countries at the appropriate sections of this privacy policy if applicable.

To protect your data, we have implemented appropriate technical and organizational measures to safeguard against loss, manipulation, or unauthorized access. These measures are continuously adjusted to the current state of technology.

Your personal data will be stored only for as long as necessary and lawful, and in compliance with the legal retention obligations imposed on us.

You have the right to request information, correction, data portability, and objection, as well as the deletion or restriction of the processing of your personal data at any time. Consents given for the processing of your personal data can be revoked at any time with future effect. However, the legality of processing your personal data until the revocation is not affected by such revocation.

If you believe that we are not processing your personal data in accordance with the law, we encourage you to contact us. You can communicate your concerns via datenschutz@quehenberger.com or dataprotection@quehenberger.com, or by mail to AUGUSTIN QUEHENBERGER GROUP GMBH, Data Protection, Gewerbegebiet Nord 5, 5204 Straßwalchen.

You also have the right to lodge complaints with the Austrian Data Protection Authority (if the data controller is an Austrian company) or with the data protection authorities in your respective country:

1030 Vienna
Phone: +43 1 52152 0

Minors under the age of 14 cannot provide valid consent for data processing. In such cases, consent must be obtained from the legal guardians. If we receive data from children under 14 years of age and become aware of it, we will promptly cease the processing of this data.

If necessary, we reserve the right to adjust our privacy policy. You can always find the current version of the privacy policy on our website at www.quehenberger.com.

When do we process data

Our website is maintained by AUGUSTIN QUEHENBERGER GROUP GMBH, located at Gewerbegebiet Nord 5, 5204 Straßwalchen, Austria (hereinafter referred to as "AQG"). Various data is collected, processed, and stored during your visit and use of our website, forms, and services.

Responsible for Data Processing:

AUGUSTIN QUEHENBERGER GROUP GMBH
Gewerbegebiet Nord 5
5204 Straßwalchen
AUSTRIA

1.1 Browser Data

When you use our websites, our web servers automatically collect and store information (access data/server log files) that your browser transmits to us. This includes information about:

  • Browser type
  • Browser version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer (IP address)
  • Time of the server request
  • Amount of data transferred
  • Message indicating whether the retrieval was successful

User IP addresses are deleted or anonymized after the use is completed. In the case of anonymization, the IP addresses are altered in such a way that they cannot be associated with a specific individual using the information available to us.

The data in the so-called log files are evaluated in anonymized form and exclusively for the purpose of improving our website and making it more user-friendly, as well as identifying and fixing technical errors more quickly. They are also used to manage server capacities, ensuring appropriate data volumes are available as needed.

The processing of access data is based on the legitimate interest pursuant to Art. 6(1)(f) GDPR. AQG's legitimate interest lies in ensuring an adequate web service offering and data security.

1.2 Cookies

Summary of Cookies

  • Affected: Website visitors
  • Purpose: Varies depending on the cookie. More details are provided below or from the software manufacturer setting the cookie.
  • Processed Data: Depends on the specific cookie used. More details are provided below or from the software manufacturer setting the cookie.
  • Storage Duration: Varies by cookie, from hours to years
  • Legal Bases: Art. 6(1)(a) GDPR (Consent), Art. 6(1)(f) GDPR (Legitimate Interests)

What are Cookies?

Our website uses HTTP cookies to store user-specific data.

The specific cookies we use depend on the services employed and are explained in the following sections of the privacy policy. Here, we briefly outline the different types of HTTP cookies.

In general, four types of cookies can be distinguished:

  1. Essential Cookies
These cookies are necessary to ensure basic functions of the website. For example, they are needed when a user adds a product to the shopping cart, navigates to other pages, and later checks out. These cookies prevent the shopping cart from being cleared even if the user closes their browser window.

  2. Functional Cookies
These cookies collect information about user behavior and whether users receive any error messages. They are also used to measure loading times and website behavior across different browsers.

  3. Targeting Cookies
These cookies enhance user-friendliness. For example, they store entered locations, font sizes, or form data.

  4. Advertising Cookies
Also known as targeting cookies, these serve to deliver individually tailored advertising to users. This can be convenient but also quite annoying.

Typically, you will be asked during your first visit to a website which types of cookies you want to allow. This decision is also stored in a cookie.

If you want to learn more about cookies and are not afraid of technical documentation, we recommend reading https://datatracker.ietf.org/doc/html/rfc6265, the Request for Comments from the Internet Engineering Task Force (IETF) titled “HTTP State Management Mechanism.”

Purpose of Processing via Cookies

The purpose ultimately depends on the specific cookie. More details can be found below or from the software manufacturer that sets the cookie.

What Data is Processed?

Cookies are small helpers for various tasks. The data stored in cookies cannot be generalized, but we will inform you about the processed or stored data in the following privacy policy.

Storage Duration of Cookies

The storage duration depends on the specific cookie and is clarified further below. Some cookies are deleted after less than an hour, while others may remain on a computer for several years.

You also have control over the storage duration. You can manually delete all cookies at any time through your browser (see also “Right to Object” below). Furthermore, cookies based on consent will be deleted no later than when you revoke your consent, while the legality of storage remains unaffected until then.

Legal Basis

Since 2009, there have been so-called “cookie regulations.” These stipulate that storing cookies requires your consent (Article 6(1)(a) GDPR). Within EU countries, however, there are varying responses to these regulations. In Austria, this directive was implemented in § 96(3) of the Telecommunications Act (TKG). In Germany, the cookie regulations were not implemented as national law; instead, they were largely implemented in § 15(3) of the Telemedia Act (TMG).

For absolutely necessary cookies, even without consent, legitimate interests exist (Article 6(1)(f) GDPR) that are mostly of an economic nature. We aim to provide website visitors with a pleasant user experience, for which certain cookies are often essential.

For cookies that are not absolutely necessary, they will only be used if you provide your consent. The legal basis in this case is Article 6(1)(a) GDPR.

1.3 Web Analytics

  • Affected: Website visitors
  • Purpose: Evaluation of visitor information to optimize the web offering.
  • Processed Data: Access statistics including data such as access locations, device data, access duration and time, navigation behavior, click behavior, and IP addresses. More details can be found with the respective web analytics tool.
  • Storage Duration: Depends on the web analytics tool used
  • Legal Bases: Art. 6(1)(a) GDPR (Consent), Art. 6(1)(f) GDPR (Legitimate Interests)

What is Web Analytics?

We use software on our website to analyze the behavior of website visitors, referred to as web analytics. Data is collected, stored, and processed by the respective analytics tool provider (also known as tracking tools). This data is used to create analyses of user behavior on our website, which is made available to us as the website operator. Most tools also offer various testing options, allowing us to see which offers or content resonate best with our visitors. For example, we can show two different offers for a limited period and, after the test (known as an A/B test), we know which product or content our website visitors find more appealing. For such testing procedures, as well as for other analytics procedures, user profiles may also be created and data stored in cookies.

Why do we use Web Analytics?

With our website, we have a clear goal: to provide the best web offering in our industry. To achieve this, we want to offer the most interesting offerings while ensuring that you feel comfortable on our website. By using web analytics tools, we can closely examine the behavior of our website visitors and then improve our web offering accordingly. This helps us understand average visitor age, their origin, peak visiting times, and which content or products are particularly popular. All this information aids us in optimizing the website to meet your needs, interests, and wishes.

What Data is Processed?

The specific data stored depends on the analysis tools used. However, generally, information is stored about which content you view on our website, which buttons or links you click, when you visit a page, what browser you use, what device (PC, tablet, smartphone, etc.) you use to visit the website, and which operating system you use. If you consented to the collection of location data, this may also be processed by the web analytics tool provider.

Your IP address is also stored. According to the General Data Protection Regulation (GDPR), IP addresses are considered personal data. However, your IP address is usually stored in a pseudonymized form (i.e., in an unidentifiable and shortened version). For testing, web analytics, and web optimization purposes, direct data such as your name, age, address, or email address are generally not stored. All data collected, if any, are stored pseudonymously, preventing your identification as an individual.

The duration of data processing depends on the provider. Some cookies store data only for a few minutes or until you leave the website, while others can retain data for several years.

Duration of Data Processing

In general, we process personal data only as long as necessary to provide our services and products. In cases where it is legally required, such as for accounting purposes, this storage duration may be extended.

1.4 Google Marketing Services

We utilize the marketing and remarketing services (collectively referred to as "Google Marketing Services") of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) based on our legitimate interests (i.e., interest in analyzing, optimizing, and economically operating our online offering in accordance with Art. 6 para. 1 lit. f GDPR).

The Google Marketing Services allow us to display advertisements for our website more targetedly, presenting users only with ads that potentially align with their interests. For example, if a user sees ads for products they have shown interest in on other websites, this is referred to as "remarketing." To this end, when visiting our website and other sites where Google Marketing Services are active, a code from Google is executed, and so-called (re)marketing tags (invisible graphics or codes, also known as "web beacons") are embedded in the website. With their help, an individual cookie, i.e., a small file, is stored on the user's device (similar technologies may also be used instead of cookies). Cookies can be set by various domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com, or googleadservices.com. This file records which websites the user has visited, which content they are interested in, and which offers they clicked on, along with technical information about the browser and operating system, referring websites, visit times, and additional information about the use of the online offering. The user’s IP address is also recorded, and we inform Google Analytics that the IP address will be shortened within the member states of the European Union or in other contracting states of the Agreement on the European Economic Area, and will only be fully transmitted to a Google server in the USA in exceptional cases. The IP address will not be merged with user data from other Google offerings. The aforementioned information may also be combined by Google with information from other sources. If the user subsequently visits other websites, they may see ads tailored to their interests.

User data is processed pseudonymously within the framework of Google Marketing Services, meaning that Google does not store or process the user's name or email address, but processes relevant data related to the cookie within pseudonymous user profiles. From Google’s perspective, the ads are therefore not managed and displayed for a specific identified person but for the owner of the cookie, regardless of who that cookie owner is. This does not apply if a user has explicitly allowed Google to process the data without this pseudonymization. The information collected about users via Google Marketing Services is transmitted to Google and stored on Google’s servers in the USA.

Among the Google Marketing Services we employ is the online advertising program "Google AdWords." In the case of Google AdWords, each AdWords customer receives a different "conversion cookie." Thus, cookies cannot be tracked across the websites of AdWords customers. The information collected via the cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers are informed of the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that allows for the personal identification of users.

We may also use the service "Google Optimize." Google Optimize allows us to track how different changes to a website affect its performance through so-called "A/B testing" (e.g., changes in input fields, design, etc.). For these testing purposes, cookies are placed on users' devices. Only pseudonymous data of users are processed in this context.

Furthermore, we use the "Google Tag Manager" to integrate and manage Google Analytics and Marketing Services on our website. The Tag Manager itself is a domain that does not set cookies or store data. It functions merely as a "manager" of the implemented tags. The data is routed through the individual tags of the different web analytics tools and is not stored.

Data that you submit to us by means of a data entry form on our website will be forwarded to the respective department for the purpose of request processing. The data will be deleted after 14 days from our web servers. Details on data forwarding can be found under "Who receives which data".

Storage Duration

This means that we delete personal data as soon as the reason for data processing is no longer present. If you wish to have your data deleted or revoke your consent for data processing, the data will be deleted as soon as possible, provided there is no obligation to retain it.
